These terms apply when you use synced.com.au and when you buy from us. The site is operated by Synced Home (trading as Synced, ABN 49 694 337 758, “we”, “us”, “our”). By using the site or placing an order, you agree to these terms. Please read them together with our privacy policy. If you do not agree with them, please do not use the site.
Who can order
To buy from us you must be at least 18 years old and able to enter a binding contract. We currently sell and ship within Australia only.
Your account
You do not need an account to shop, but if you create one you are responsible for keeping your login details secure and for activity that happens under your account. Tell us straight away if you think your account has been used without your permission. We may suspend or close an account if it is misused or these terms are breached.
Products, pricing and availability
- All prices are in Australian dollars and include GST unless stated otherwise. Delivery is charged separately and shown at checkout.
- We try to keep product descriptions, images, specifications and prices accurate, but errors can happen. Product images and packaging are a guide only.
- Products are subject to availability. We may change or discontinue products, and update prices, at any time before you order.
- If we discover a genuine pricing or description error after you order, we will contact you to confirm whether you want to continue at the correct price, or cancel the order for a full refund.
Orders
When you place an order you are making an offer to buy. Our order confirmation acknowledges we have received your order; a contract is formed when we accept it, which we do when we dispatch the goods. We may decline or cancel an order (for example, if an item is out of stock, we cannot verify your details, we suspect fraud, or there was a pricing error). If we cancel an order you have paid for, we will refund you in full.
Payment
We accept the payment methods shown at checkout. Payments are processed securely by our payment provider, and we do not store your full card details. You confirm you are authorised to use the payment method you provide.
Delivery, returns and warranties
Delivery timeframes and costs are set out on our shipping and delivery page. Risk in the goods passes to you on delivery. Change-of-mind returns are covered by our returns and refunds page, and faulty or defective items by our warranty page.
Your consumer rights
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure. Nothing in these terms limits or excludes those rights.
Using the site
You may use the site for lawful personal purposes only. You agree not to misuse the site, interfere with its operation or security, or attempt to access it in ways we have not authorised. The content on the site (including text, images, logos and design) is owned by us or our licensors and is protected by law; you may not copy or reuse it without our permission, except as allowed by law.
Reviews and content you submit
If you submit a review, comment or other content, it must be accurate, your own, and not unlawful, misleading or offensive. You grant us a non-exclusive, royalty-free licence to use, display and reproduce that content in connection with our business. We may remove content that breaches these terms.
Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot be excluded. Subject to that, and to the extent permitted by law, we are not liable for indirect or consequential loss, and where our liability can be limited, it is limited to resupplying the goods or paying the cost of resupply.
Changes to these terms
We may update these terms from time to time. The current version will always be on this page, with the “last updated” date at the top. The terms that apply to your order are the ones in force when you place it.
Governing law
These terms are governed by the laws of Victoria, Australia, and you and we submit to the courts of that state and the Commonwealth.
